This Privacy Policy explains how Domain DESGNR ("PresenceOS", "we") collects, uses, shares, and protects personal information when you use PresenceOS (the "Service"). Contact: privacy@presenceos.io, PresenceOS, Inc.

Summary

  • We collect the account and brand information you give us, the assets you upload, tokens for accounts you connect, billing identifiers (via our payment processor — we don't store card numbers), and usage/diagnostic data.
  • We use it to run the Service: generate your brand, website, and content, publish on your behalf, bill you, support you, secure the platform, and improve it.
  • We share data with AI model providers and infrastructure vendors (sub-processors) that power the Service, and with parties you direct (e.g., social platforms you connect). We do not sell your personal information.
  • AI features send your Inputs to third-party AI model providers. See the AI Usage Disclosure.
  • You have rights to access, correct, delete, and port your data, and to opt out of certain processing.

1. Who is responsible for your data

  • For your account and use of PresenceOS: we are the controller.
  • For data on the websites we generate for you and the content you publish (your end customers / site visitors): you are the controller and we act as your processor. Our processing of that data is governed by our Data Processing Addendum (DPA). You are responsible for providing your visitors any required notices and choices.

2. Information we collect

a. Information you provide

  • Account data: name, email, password (via our auth provider), and business details.
  • Brand & business Inputs: the information you enter during onboarding and in the product (business description, audience, offers, tone, goals, website messaging, etc.).
  • Uploaded assets: logos, images, reference files, and other materials you upload.
  • Communications: messages to support and pre-signup chat sessions.
  • Payment data: processed by our third-party payment processor; we receive billing identifiers and subscription status, not full card numbers.

b. Information collected automatically

  • Usage & device data: pages/actions, timestamps, IP address, browser/device info, via our product-analytics and error-monitoring providers.

c. From third parties you connect

  • Connected Account data & tokens: when you link a publishing or social account (via a third-party publishing provider), we store access tokens and limited profile/publishing data needed to act on your behalf. Where third-party platform APIs are used, our use complies with those platforms' applicable user-data policies, including any limited-use requirements.

3. How we use information

  • Provide the Service: generate brand assets, websites, and content, and publish to your Connected Accounts at your direction.
  • Operate AI features by transmitting Inputs to third-party AI models (see AI Usage Disclosure).
  • Authenticate you, process payments, and enforce plan limits.
  • Provide support, send service and transactional messages, and (with consent where required) marketing.
  • Secure, debug, and improve the Service, including with de-identified/aggregated data.
  • Comply with law and enforce our Terms and Acceptable Use Policy.

4. Legal bases (EEA/UK)

Where GDPR/UK GDPR applies, we rely on: performance of a contract (to provide the Service), legitimate interests (to secure and improve the Service, prevent abuse), consent (for certain cookies/marketing), and legal obligation. You may withdraw consent at any time.

5. How we share information

We share personal information with:

  • Sub-processors that power the Service, including:
    • AI models: third-party AI model providers (text, image, video, and voice generation).
    • Infrastructure & operations: providers for hosting, database/authentication, file storage, media processing, content delivery (CDN), payment processing, social publishing, product analytics, error monitoring, and email and marketing/CRM.
    • A current list is maintained at [sub-processor list URL].
  • Parties you direct — e.g., social platforms and destinations you connect and publish to.
  • For legal reasons — to comply with law, enforce terms, or protect rights and safety.
  • In a business transfer — e.g., merger, acquisition, or asset sale.

We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California and other U.S. state laws. (Confirm against actual analytics/marketing configuration — see attorney notes.)

6. AI features

The Service uses third-party AI models to generate Output from your Inputs. Inputs are transmitted to these providers to produce Output. Provider handling of data — including whether data is used to train their models — is governed by their terms; our configuration and current understanding are described in the AI Usage Disclosure. Do not submit sensitive personal information you don't want processed by AI providers.

7. International transfers

We and our sub-processors may process information in the United States and other countries. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses) for transfers from the EEA/UK/Switzerland. Details are in our DPA.

8. Retention

We keep personal information for as long as your account is active and as needed to provide the Service, then for a reasonable period to comply with legal, tax, security, and dispute-resolution needs, after which we delete or de-identify it. You can request deletion as described below; some data in backups or logs may persist for a limited time.

9. Security

We use technical and organizational measures appropriate to the risk, including access controls and per-tenant data isolation (row-level security). No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

10. Your rights

Depending on where you live, you may have rights to access, correct, delete, port, or restrict processing of your personal information, to opt out of certain processing, and to withdraw consent. You can manage core account data in-product or contact privacy@presenceos.io. We will verify your request and respond within the time required by law. You may appeal a decision and, where applicable, complain to your data protection authority. We will not discriminate against you for exercising your rights.

California/US state residents: see the categories of information, purposes, and sharing described above; you have rights to know, delete, correct, and opt out of sale/sharing (we do not sell/share as defined). Submit requests to privacy@presenceos.io.

11. Children

The Service is not directed to children under 18 and we do not knowingly collect their personal information. If you believe a child provided us information, contact us and we will delete it.

12. Changes

We will post updates here and revise the "Last updated" date; for material changes we will provide additional notice.
