This Acceptable Use Policy ("AUP") is part of and incorporated into the Terms of Service. It applies to your use of PresenceOS (the "Service"), to everything you submit (Inputs), to everything the Service generates for you (Output), and to anything you publish through the Service. Capitalized terms have the meaning given in the Terms. We may update this AUP as the Service and the law evolve.

You are responsible for your Inputs, your Output, your Generated Site, and everything published through your Connected Accounts.

1. You may not use the Service to create, upload, or publish content that:

  • is illegal, or promotes or facilitates illegal activity;
  • infringes or misappropriates intellectual-property rights, or violates privacy or publicity rights;
  • is defamatory, harassing, hateful, or incites violence;
  • is sexually explicit, or sexualizes or exploits minors in any way;
  • contains malware, or is designed to deceive, defraud, or phish; or
  • contains another person's personal or sensitive information without authorization.

2. Prohibited AI / generative uses

Because the Service generates media (including images, video, brand characters, and synthetic voices), you may not use it to:

  • impersonate a real person, business, or organization, or create deceptive deepfakes or content falsely presented as real;
  • generate a likeness or voice of a real, identifiable person without that person's consent;
  • produce disinformation, fake news, or content designed to deceive about its AI origin where disclosure is required;
  • generate content intended to infringe a third party's copyright, trademark, or other rights (including by submitting infringing Inputs or prompts engineered to reproduce protected works);
  • generate content that discriminates unlawfully or facilitates serious harms (e.g., weapons, self-harm, fraud); or
  • attempt to defeat or bypass safety filters of the Service or its underlying AI models.

3. Prohibited publishing / automation uses

The Service can publish to your Connected Accounts. You may not use it to:

  • send spam or unsolicited bulk messaging, or post at volumes or in ways that violate a destination platform's rules;
  • generate fake engagement, bots, or artificial traffic;
  • evade a platform's moderation, bans, or rate limits; or
  • publish content that violates the terms or community guidelines of any destination platform. You are responsible for complying with each platform's rules.

4. Prohibited technical conduct

You may not: reverse-engineer, decompile, or scrape the Service; probe or breach security or access controls; access data that isn't yours or other tenants' data; use the Service to build a competing product, model, or dataset; resell or sublicense the Service without authorization; or place unreasonable load on, or interfere with, the Service or its providers.

5. Generated Sites

Your Generated Site and the data you collect from its visitors must comply with this AUP and applicable law, including providing visitors any legally required notices and choices. Do not use a Generated Site to host prohibited content or to collect data deceptively.

6. Enforcement

We may investigate suspected violations and may remove content, disconnect accounts, suspend or terminate access, take down Generated Sites, and report unlawful activity, with or without notice depending on severity. We may also act when a destination platform or provider requires it. Repeated or serious violations may result in termination without refund.
